Federal Appeals Court Ruling on Department of Education Lawsuit

A federal appeals court has officially cleared the way for approximately 170,000 student loan borrowers to receive automatic debt cancellation. This important decision comes after the court rejected the Department of Education attempt to postpone obligations under a landmark settlement.

The legal dispute concerns Sweet versus McMahon, which is a long running class action lawsuit brought by affected student borrowers. These individuals argued that their respective colleges misled or defrauded them while the Education Department failed to process relief requests.

The judicial ruling does not establish a brand new nationwide student loan forgiveness program across the country. Instead, it strictly requires the department to comply with concrete deadlines contained in an existing court approved agreement.

This agreement directly involves applications submitted through the specific Borrower Defense to Repayment program.
